📝🤝 The task of the working group is to contribute in an advisory capacity to the drafting of the new Anti-Corruption Act, advise the ministry, make proposals, and provide substantive feedback.
🔎 As a result of various discussions and consultations, the Ministry of Justice and Digital Affairs has concluded that the current Anti-Corruption Act (ACA) is no longer sufficient to effectively manage horizontal corruption risks that occur across different sectors.
📚 At the same time, society requires greater legal clarity, and the provisions used in criminal law must be clearly distinguished at the legislative level. The need for greater clarity—particularly in defining related persons and restrictions on acts—has also been highlighted by recent court cases that have received extensive media coverage.
🤝 The Eesti Advokatuur stands for the principle of legal certainty as part of the rule of law and finds that legal provisions need to be drafted more clearly and assessed as to whether the current regulation meets societal expectations.
In addition to the Bar Association, representatives of the Riigiprokuratuur, Riigikohus, Kaitsepolitseiamet, Politsei- ja Piirivalveamet, Siseministeerium, Eesti Linnade ja Valdade Liit, the Tartu Ülikooli õigusteaduskond, the Ametnikueetika nõukogu, and MTÜ Korruptsioonivaba Eesti, as well as independent experts, are also participating in the working group.
