In the past year, Kadri Matteus and Mario Sõrm got together and discussed what to expect in public procurement law in the current year. Fees doubled already from 1 January, and in the spirit of simplification other important changes are also expected to enter into force from 1 June.
Thresholds will be increased, the national threshold will be abolished, and procedurally the contracting authority will gain the possibility to reduce the administrative burden in conducting procurements (checking compliance of the tender only for the successful tenderer, restoring a single consolidated decision, and abolishing the average wage certificate in construction procurements, to name just a few).
Finally, a reminder to public procurement lawyers that when conducting a procurement on behalf of a contracting authority or substantively directing it, the lawyer is also considered to have the status of a public official and must observe the obligation to recuse themselves from advising if decisions need to be made in respect of a person connected to the lawyer.
