MARIT PIIRISAAR AND KADRI MATTEUS: ISSUES IN ORGANIZING PUBLIC PROCUREMENT
In the organization of public procurement, there are structural problems that are surmountable but require broader discussion and awareness among all Estonian procurers. Violations of public procurement law are also a reason why structural funds often have to be repaid to the European Union, writes Kadri Matteus in a piece together with Marit Piirisaar.
The amendments to the Public Procurement Act, which entered into force on June 1st 2022, prompt procurers to review their previous procurement practices in order to adhere to the updated regulations of the Public Procurement Act in the future.
Procurers are also encouraged to review their procurement practices based on errors identified in the public procurement supervision proceedings, which allow procurers to receive feedback on their activities and learn from identified mistakes to prevent violations in future public procurements. While one aim of the planned supervision proceedings for public procurement is to provide the Ministry of Finance with a comprehensive overview of procurement practices to shape the existing legal framework, it also enables procurers to adjust their conduct of public procurements. For this purpose, it is possible to familiarize oneself with the annual summaries of public procurement supervision, which highlight, among other things, the main structural problems in the application of public procurement regulations.
