Dynamic Purchasing System (DPS)

We’re delighted to share that in the special issue 2025/6–7 of Juridica, our lawyer Merily Tamm (Rool) has published an in-depth article titled “The Dynamic Purchasing System as a Public Procurement Instrument: Legal Possibilities and Practical Realities.”


The article explores one of the most flexible tools in public procurement — the Dynamic Purchasing System (DPS) — examining its nature, practical applications, and related legal issues.

It focuses, among other things, on:
which types of procurement objects may be acquired through the system, and
how precisely contracting authorities must define the technical specifications of future contracts when establishing the system.

The Dynamic Purchasing System represents a step toward simplifying and increasing the efficiency of public procurement, yet it also introduces new legal challenges — all of which Merily’s article addresses through thorough analysis and a practical perspective.
